Brief History
1. All India Gorkha Ex-Servicemen's Welfare Association (AIGEWA) is a prestigious organisation of all Gorkha Ex-Servicemen’s in all overIndia . The Organisation had come into its existence on 26 Nov 1950. This was formed during the onset of Second World War for the proper administration / welfare of Gorkhas settled in India for which a sum of Rs 40 Lacs corpus money was generated & received from Post War Reconstruction Fund in 1947. The Post War Reconstruction Fund was created by the British India Govt. on 3 April 1942 when the great World War II had broken out. It was made for the Welfare and rehabilitation of thousand of those Indian Soldiers and Gorkha Soldiers of Nepal who had fought alongside the Britishers in the World War II right from beginning to its end ie, 3 Sep 1939 to 8 Nov 1945. British India Govt.had visualized that one day the War would come into its end and after completing their service several of those soldiers had to be de-mobilized. Hence for their welfare and rehabilitation a fund was created known as “Post War Reconstruction Fund” (PWRF) in April 1942. In this “Post War Reconstruction Fund” (PWRF). The Govt. every month contributed Rupees two for each combatant and one rupees for non combatant. Consequently World War II ended on 08 Nov 1945 when America ’s fighter plane dropped atomic bombs on Japanese busy cities of Hiroshima and Nagasaki causing huge destruction of human lives.

2. The whole amount accumulated in the PWRF during the 6 Year World War II were as under: -
(i) Army - .19,35,24,000.00
(ii) Royal Indian Navy - . 13,31,000.00
(iii) Royal Indian Air Force - . 11,84,000.00
Total - .19,60,39,000.00.
3. Govt. decided to with hold 20% of PWRF as corpus money for the welfare of other Indian Ex-Servicemens in future and rest of the shares were distributed to various provinces and Indian state for their troops. During these period our neighboring countries likeBurma , Pakistan , Srilanka Nepal were considered as provinces and states like Gwalior , Hydrabad etc. of local Rajya/ Zamindars under British India rules.
4. In the process an amount of Rs 54 Lacs came into the share of Nepal and this entire amount were sent to Nepal without retaining any share for the Gorkhas who had settled in India. Despite sacrificing their valuable lives in the battle field of World War II, legitimate rights of Indian Gorkhs were ignored. Having found such injustice some of elite Indian Gorkhas like Ari Bahadur Gurung, Bar- at – Law (Darjeeling ) then member of Parliament (Ist Lok Sabha of Independent India), Dilip Singh Thakur, New Delhi , LR Josse, MLA Calcutta, Shri Dhan Singh Thapa, New Delhi , Sheel Chand Thakur, New Delhi etc. unitedly came forward to protest against this issue. Not only this they also formerly formed an organisation called as “Indian Gorkha Ex-Servicemen’s Welfare Fund” (IGEWF) which was later on became the mile stone in formation of AIGEWA. Through this IGEWF, they put forward the strong demand of PWRF shares for Indian Gorkha Ex-Servicemen also. Ultimately Govt. of Nepal agreed to offer .10 Lacs out of their shares and Govt. of India also provided .30 Lacs more. Thus the amount of 40 Lacs were made as corpus money for the welfare known as Indian Gorkha Ex-Servicemens Fund (IGEWF). The Govt. advised Shri Ari Bahadur Gurung, MP to form an organisation in all India basis for the administration of .40 Lacs to be utilized for welfare activities.In the mean time All India Gorkha Ex-Servicemen's Welfare Association (AIGEWA) was formed on 14 Feb 1951 as per the Govt. order and registered as S-476 of 1950 and recognized by Govt. of India, Min of Defence .
5. Under the direction of the Min. of Defence the first meeting of IGEW Fund was held on 20 Mar 1951 in which AIGEWA was formally formed. This meeting was inaugurated by Shri Ari Bahadur MP at the Constitution Hall of Parliament House, New Delhi in the august presence of Shri Himat Singh Jee, Minister and Shri HM Patel, ICS then Deputy Defence Secretary and 10 representatives of Gorkha Ex-Servicemen’s (GESM) of Assam Shillong, Darjeeling, Dehradun, Bhagshu, Dharamahsala, Nautanwa, Shimla, New Delhi. In this meeting Shri Ari Bahadur Gurung was elected AIGEWA’s first President, Shri LR Josse, MLA, Vice President and Shri DS Thakur, General Secretary.
6. It is also worth mentioning here that in the meeting Govt. ofIndia , Min of Defence clarified that they will not deal with the affairs of Gorkha Ex-Servicemen’s living in various parts of India . Hence , the Govt. instead authorized AIGEWA to make recommendation to the Min of Defence for the smooth administration of Indian Gorkha Ex-Servicemen’s Welfare fund set up under Govt. of India letter No.27-8B(124)/49/I/1267/D(AG) dated 14 Feb 1951. This is the historical facts regarding the formation of AIGEWA for which all Indian Gorkha Ex-servicemen should feel proud of it.

Aim and Objectives
10. The objects of the Association shall be to frame & formulate such scheme or schemes from time to time as may be conducive to further & promote the economic, social educational etc.particularly of those Gorkhas who have actually served in the ranks or who may be in active military service & also for the advantage of their sons & brothers , wifes & daughters.

To render such assistance – pecuniary etc. to widows, orphans, destitutes and other needy members of the community as
may be possible out of alloted funds or which may be cotributed for such
objects.
(b) To consider and put into force all
proposals received by the association from associate organizations for
benefits, assistance or aids etc. to members of the community.
(b) (c) To set up new destitute homes, schools, institutions
etc. and to maintain those already established in India .
(c) (d) To lay down policies regarding investment, disbursement
and utilization of the funds belonging to the Association.
(e)
To collect and receive funds, contributions from
Government, various organisation and individuals etc. to full fill the objects
for which the Association has been formed.
(f)
To render financial support to the deserving financially
poor children of ex-servicemen, who are studying from class VI to BA and above
through scholarship.
(g)
To conduct free 3 months vocational training of
professional courses like , Beautician, computers, carpet weaving, soft toys
making and cutting tailoring, knitting, embroidery, painting and fabric
painting in achieving self reliance.
(g) (h) To spread social & educational awareness among the
society for the upliftment of community.
Management And Utilization
Of Fund
11. The main objective of the fund is to
offer grant to promote the economic , social & educational welfare of the
Gorkhas & also to render assistance to orphans , widows & destitudes. A
committee was thus formed to administer the fund. The Chairman was the Secty
Min Of Defence and President AIGEWA ,The DGR & Secty KSB were also the
members. The corpus money of
.40 lacs was
subsequently
merged with Flag day Fund under Ministry of Defence Govt. of India, New Delhi
wef. Year 2000. This is under the
supervision of Kendriya Sainik Board Army Headquarters, RK Puram, New Delhi .
Interest of the Corpus Money are provided to AIGEWA every year as an Annual
Budget for utilization &
implementation of various welfare activities / projects of Indian Gorkha
Ex-Servicemen, their widows and dependents in the shape of stipends /
scholarship, vocational trg , funeral grant, DD-40, Daughters marriage and loss
of property due to natural calamities.
(a) The Annual Budget till FY- 2006-2007 was
only
5 Lacs .
(b) From FY 2007-2008 it was increased to
8 Lacs.
(c) Presently , due to increase in awareness & spreading
of AIGEWA activities / launching of various wefare projects
8 Lacs budgets is also felt inadequate to carry out projects / programmes by the Association. The shortage of funds is
also attributed to all round inflation factors thus , AIGEWA had forwarded a Statement of Case
requesting for Enhancement of the Yearly Grant . (Copy attached as Appx “ D”)

Infrastructure
13. AIGEWA receives no maintenance funds from the Govt
sources , and is depended on voluntary contributions for its self sustenance .
However, due to persistent efforts it was able to obtain sanction & construct
a Multipurpose Home (MPH), at Vijaypur-
Hathibarkala (Naya Gaon) Dehradun in
1999 at a cost of
.28 lacs. The amount
was sanctioned through Kendriya Sainik Board, New Delhi. The Multipurpose Home (MPH) houses Hq
AIGEWA office , has a small Library cum Conference Hall, Coaching Class rooms for computers, ladies Vocational Training Class room . Beside this, we are
maintaining guest rooms / dormitory accommodation having 18 beds , dining hall and
kitchen, for stay of out station guests / delegates during Annual General
Meeting / members visiting the Hqs.
Financial Grant
14. The
All India Gorkha Ex-Servicemen's Welfare Association receives Annual financial
assistance through the Kendra Sainik Board to the extent of
8 Lacs. This is distributed amongst the Gorkha
Ex-Servicemen and their dependents as financial assistance from Kendriya Sainik
Board, New Delhi for the following
purposes: -

(a)
Stipends for school going children, higher education
and technical courses.
(b)
Special assistance to outstanding students for the
purchase of course books.
(c)
Honorarium to teachers and instructors for running of
educational coaching classes. Vocational training like machine knitting, tailoring, machine
embroidery, fabric painting, soft toys making, cooking, preservation of food,
personal hygiene and Beautician etc.
(d)
Preparatory coaching class for entrance examination of
union public service commission viz. IAS, IPS, PCs.
(e)
Preparatory coaching class for entrance test of
National Defence Academy, Officer Training Academy, Indian Military Academy.
(f)
Financial assistance for boosting sports like soccer
and boxing.
(g)
Financial Assistance to meet funeral expenses.
(h)
Financial Assistance for marriage to the daughters of
widows.
(i)
Financial assistance to some deserving, elderly
Ex-Servicemen and their widows. We also assist them with small cash for
purchase of medicines, whenever the same are not provided by ECHS.
(j)
Special monthly allowance to Handicapped children of
Ex-Servicemen who are mentally retarded from birth, blind or suffer from polio
cases.
(k)
Financial assistance for repairing houses to needy and
deserving ex-servicemen, damaged by natural calamities.

RULES & BYLAWS
Rules of the All India Gorkha Ex-Servicemen's Welfare Association
Name
1. The Association has been formed for the general welfare of
the Gorkha Ex-Servicemen and their dependents settled in India and has come
into being by a resolution passed at a meeting of the representatives of (i)
Gorkha Ex-Servicemen's Association, Darjeeling, (ii) Assam (now Meghalaya)
Gorkha Ex-Servicemen's Welfare Union, Shillong, (iii) Gorkhali Sudhar Sabha,
Dehradun, (iv) Himachal & Punjab Gorkha Ex-Servicemen's Association,
Dharamshala and (v) Gorkha Association, Shimla held in New Delhi on sunday the
26 Nov. 1950 and will be called "
All India Gorkha Ex-Servicemen's Welfare Association”. Later on, Himachal
Pradesh Gorkha Ex-Servicemen's Welfare Association, Bakloh, Gorkha
Ex-Servicemen's Welfare Union, Nautanwa, Punjab Gorkha Ex-Servicemen's Welfare
Association, Pathankot and Gorkha Sudhar Sabha, (Jammu& Kashmir) were
Affiliated to the Association.
Objects
2. The objects of the Association are to frame and formulate
such scheme or schemes from time to time as may be conducive to further and
promote the economical, social and educational welfare of Gorkhas who have
actually served in the ranks or non-combatants (enrolled) in the Defence
Services or who may be on active military service and also for the advantage of
their sons and brothers, wives and daughters, other dependents or future
generations of the families and to render such assistance pecuniary etc to
widows, orphans, destitute and other needy members of the community as may be
possible out of the funds which may be especially collected for such objects.
The scheme so framed shall be submitted to the Ministry of Defence or such
other authority or authorities as may be controlling the funds contributed by
the Government or any other organizations, individuals etc. for objects as
aforesaid.
Funds
3. The funds of the Association shall consist of: -
(a)
Grants allocated by the Government of India from time
to time.
(b)
Ad-hoc grants received from Government of India from time
to time.
(c)
Voluntary contributions.
(d)
Income from sale proceeds of properties, rents, other
incomes etc. i.e.,
Properties
donated or received by the Association from time to time; or any other source
for the general welfare of the ex-servicemen and their families in India as
defined in clause 2 above.

4. The Headquarters of the All India Gorkha Ex-Servicemen's
Welfare Association (AIGEWA) will be located at Multi Purpose Home (MPH),
Village- Vijaypur Hathibarkala (Naya Gaon) , PO- Anarwala, Tehsil and District:
Dehradun, Uttarakhand, Pin code-248003.

AIGEWA may also co-opt individual as a member who
fulfills qualification as laid down in Clause 6.
6. The Office Bearers (the President, Vice Presidents and
General Secretary) will be elected by the majority of members during the
"Triennial" Annual General Meeting (AGM) and shall hold office for a
period not exceeding 3 years. The Office Bearers so elected should be members
of the AIGEWA or any of its Affiliated Organization. However, Gorkha Ex-
Servicemen and Civilians settled in India, with good proven record of social
service should also be made eligible for direct election as Office Bearers of
the Association. He should be a member of any Affiliated Organization. In the
event of incomplete quorum the AGM, voting by proxy shall not be allowed.
General Secretary will be elected for three years tenure by the house in AGM like other Office Bearers.
However, Secretary and Treasurer will not be elected by the house. They will be
nominated by the President in consultation with General Secretary and shall
have no voting rights. In case of vacancies occurring during the currency of
the period for which a member has been elected from the Affiliated
Organisation, the Association shall ask the respective Organization to elect a
representative to fill up the vacancy so caused; in all other cases, vacancies
shall be filled by the President in consultation with the members of the
Association. The President would be made a life member of the Association after
completion of tenure. The Office Bearers will be eligible for re-election
without let or hindrance.
7. All powers of investment, control and disbursement of funds
allocated by the Government of India shall vest in the Association but all
measures pertaining to the above will be acceptable only when passed in AGM by
not less than 2/3rd majority of members.
Functions
8. The functions of the Association shall be: -
(a) To consider all proposals received by
the Association from Affiliated Organizations for the benefits, assistance or
aids etc.
(b) To lay down general policies with regard
to all matters for the educational, economical and social upliftment of the
community.
(c)
To consider claims for pecuniary assistance for the
already Established Homes, school and institutions etc.
(d)
To make policy regarding the investment, disbursement
and utilization of funds.
(e)
To co-ordinate all educational, social and economical
schemes submitted by the Affiliated
Organizations.
(f)
To collect and receive funds and contributions from
various Organizations and individuals
etc.
(g)
To advance
grants and spend funds for the general welfare and well being of Gorkha ex-
servicemen,
widows and their dependents in India through Affiliated Organization.
(g) To deal with all matters ancillary to
the aforesaid objects for which the Association has been formed.
Investment
9. The fund of the Association shall normally be invested in
Government securities, debenture or other gilt- edged or such other stock and
securities as may be to the best advantage of the Association.
Management
10. The Office Bearers of the Association
shall constitute a Managing Committee. The Association shall set up a small
Secretariat for day today disposal of the correspondence and to such routine
matters as may be necessary. The Secretariat Office shall consist of such staff
as may be decided upon by the Association at its meeting from time to time. The
General Secretary will be executive head of the Secretariat. The Treasurer will
be entrusted with a small imprest of Rs 2000/- for meeting expenditure of
contingent nature.
Property
11. Any movable or immovable property of the
Association shall vest and be managed by the Managing Committee and may be
disposed off under the authority of the Association duly passed by AGM.
Similarly the Association shall have power to transfer, lease or dispose off
any immovable property or properties duly passed by AGM. All the income and the
property of the Association from wheresoever’s received shall solely be spent
on the objects of the Association and no portion of it shall be distributed
among its members by way of profits, dividends or bonus etc. Besides this,
under no circumstances all movable or immovable property donated/inherited or
purchased shall be registered in the name of any Office Bearers, but shall be
registered in the name of Association only. The receipt of such property shall
also be made in the name of the Association.
Contracts
& Deeds
12. All agreement, contracts, power and deeds shall be executed on
behalf of the President and the General Secretary or by any two of the Office
Bearers or members subject to the prior approval of the Association.
Account
13. The accounts of the Association shall be audited annually by a
Chartered Accountant who will certify to the correctness of the balance sheet
and the accounts of the Association.
Bank
Account
14. A joint account with such a bank shall be operated upon by the
President and General Secretary/ Treasurer.
Meetings
15. (a) The Annual
General Meeting of the Association shall be held at least once a year for which
one month's notice in writing may be given. The meeting should normally be held
at the Headquarters of AIGEWA, Multi Purpose Home (MPH) Naya gaon at Dehradun.
However, such meeting can also be organized at the Headquarters of any
Affiliated Organizations, if requested by them. Any emergency meeting of the
Office Bearers of the Association may be called, if necessary, by giving one
week's notice.
(b) A meeting can also be convened by a
written requisition duly signed by not less than 2/3 members of the Association
and for such a meeting not less than three week's notice has to be served.
Remuneration
16. The Association may compensate any members or Office Bearers
or such other person, other than the paid staff of the Association, as may
render service to the Association by way of an honorarium sanctioned by a
resolution passed at a meeting of the
Association.
Traveling
Expense
17. Traveling Expense and out of pocket expenses to members, who
may be attending meeting at the Headquarters or outside the Headquarters shall
be admissible according to Bye-Laws which may be framed by the Association.The members of the association shall be eligible for the following allowances:-
(a) Rail fare - Actual Second Class fare from the place of meeting & back by the shortest route.First class/AC2tier to those members who at time of retirement/in view of their professional status were entitled to travel in1st class / AC tier.
(b) Road Mileage - As authorized by the Govt of India to its employees.
18. Daily allc Rs100/- per day for the journeys & halts provided the halts/absencefrom the HQ exceeds 8 consecutive hours. In case of the President he will be auth Rs 150/- per day. President may grant general or individual exemptions from the operations of this rule if satisfied that;-
(a) Prolonged halt was necessary in the interest of the Org.
(b) After 10 days extra expenditure will be borne by the member.

Special
Instruction
18. The Association may frame such Regulations or the Enactment of
new bye-laws as may be found necessary from time to time for the efficient
management of its affairs. No amendments to Rules, Bye-Laws or the Enactment of
a new bye-law shall be made except by a majority of 2/3rd of the total numbers
of members of the Association present at any one meeting and shall comply with
the requirement of Section 12 of the Societies Registration Act.
Filing of Name of Managing Committee
19. Once every year on or before the 14th day succeeding the day
on which the Triennial Meeting of the Society is held, a list shall be filed
with the Registrar of Joint Stock Companies of the names and addresses and
occupation of the members of the Managing Committee.
Dissolution of the Association
20. If upon the dissolution of the Association and after the
satisfaction of all its debts and liabilities any property whatsoever, the same
shall not be disbursed or immovable property distributed among its members but
shall be transferred to some other similar society as required by Section 14 of
the Societies Act.
BYE LAWS OF THE
ALL INDIA GORKHA
EX-SERVICEMEN’S
WELFARE ASSOCIATION
Name
1. This Association shall be called "The All India Gorkha
Ex-Servicemen's Welfare Association". It is registered as an Association
under Registration of Societies Act XXI of 1860 and is recognized by the
Government of India and its registered address is Village: Vijaypur Hathibarkala
(Naya Gaon) , P.O: Anarwala, District: Dehradun, Uttarakhand, Pin Code-248003.
Objects
2. The Objects of the Association shall be as follows: -
(a) To frame and formulate such scheme or
schemes from time to time as may be conducive to further and promote the economical, social and
educational welfare of Gorkhas who have actually
served
in the ranks or as non-combatants (enrolled) in the Defence Services, or who
may be in active Military Service and
also for the advantage of their sons, brothers, wives and daughters or other dependents or future
generations of their families Particularly.
(b) To render such assistance-pecuniary etc.
to widows, orphans, destitute and other needy members
of the community as may be possible out of funds, which may be especially
collected for such objects.
(c) To consider and put into force all
proposals received by the Association from Affiliated organisations for the benefits, assistance or aids etc.
to members of the community.
(d) To lay down general policies with regard
to all matters for the educational, economical and
social uplift of
the community.
(e)
To set up new destitute homes, schools, institutions etc.
and to maintain those already
established in
India.
(f) To lay down policies regarding investment,
disbursement and utilization of the funds belonging to the Association.
(g) To co-ordinate all educational, social
and economical schemes submitted by the Affiliated Organizations.
(h)
To collect or receive funds/contributions from various organizations
and individuals etc.
for prosecution
of objects for which the Association has been formed.
(i)
To spend funds on matters effecting the general welfare
and well being of Gorkhas in India
in accordance
with rules and regulations which may be framed by the Association from time to
time.
(i) To
deal with all matters ancillary to the aforesaid objects for which the
Association has been formed.
Membership
3. The Members shall consist of: -
(a) Persons who signed the application for
registration.
(b) Persons admitted in accordance with the
Rules of the Association.
4. In accordance with the Constitution of the Association shall
at present consist of founder
membership, office bearers, representatives of the Ex- Servicemen’s Organizations etc. duly authorized at a
meeting of that organization. This number may be increased and representatives
of other Gorkha Organizations catering for the welfare of ex-servicemen, who
have not so far been included, may be admitted, on application, as members
subject to the approval of the Association.
5. Application for the future membership of the Association
shall be made to the General Secretary, who shall dispose off the application
either by circulation of papers to the members or at a regular meeting of the Association.
The Association shall have power to grant admission or refuse it without
assigning reasons. “Fresh application for affiliation with the AIGEWA Association
shall not be considered from Organizations who are not eligible for the
membership with the AIGEW Association”. However to ensure full participation of
all representatives of Gorkha Ex- Servicemen’s organizations functioning at
Tehsil or Sub Divisional level active representation shall be given to all affiliated
association in the District/Regional or state level in the jurisdiction.
6. Any Organizations already Affiliated or to be affiliated to
the Central Association shall be required to pay an entrance fee of Rs.100/-
annual subscription of Rs.250/- to the Association, no entrance fee being
payable by the organizations who are already affiliated. When this fee has been
paid, the representative shall be deemed to have reserved all rights and
incurred all the obligation, and responsibilities of a member of the
Association as laid down in the Act, Rules and these Byelaws. If an Affiliated
Organization is in arrears for one year to pay the subscription as stipulated
above, the name of the representative of the Organization will be removed from
the membership after serving due notice
of one month is served.
7. Members representing the Ex- Servicemen’s Organization shall
be elected by members at their regular meeting. For this purpose, the General
Secretary shall write to the Organizations concerned at least two months before
the expiry of the period of membership of the Association. In the event of no
nomination being received, the vacancy will be treated as an interim vacancy
and filled up by the President of the Association in consultation with the
President of the organisation concerned.
8. While a representative of the regional Affiliated Associated
Organizations is elected as a member of the Association in the manner
prescribed in clause 7 above, a copy of the Resolution to this effect duly
endorsed by the Chairman of the meeting shall be forwarded to the General
Secretary of the Association. On receipt of the copy of the Resolution, the General
Secretary shall scrutinize the papers and place them before the members of the
Association. Once a representative has been elected from the Associate Organizations,
he shall continue to be the representative for the Affiliated Organization till
the next election is held, except as provided in clause 10 below. The Associate
Organization shall, however, have the power to recall and replace
representative from the Association.
9. The Association may, by a resolution, declare a vacancy
having occurred, if a member of the Organizations absents himself from two
consecutive meeting without intimating in writing his inability to attend, in
which case the Associate Organization shall be asked to fill up the vacancy
thus caused by electing another representative at their regular meeting as per
clause 7 above.
Termination of Memberships
10. The membership will be terminated in the event of: -
(a) (i) Death.
(ii)
Insanity.
(iii)
Declaring in writing to the General Secretary his
intention to resign.
(iv)
Becoming a paid employees of the Association.
(v)
Any action, which may be found by the Association to be
dishonest or contrary to
the stated objects of the Association.
(b)
When a member resigns his
membership, he shall send a letter of resignation to the
General
Secretary and such resignation shall
take effect from the date/his resignation is accepted by the Associate
organisation , the members shall send intimation of their resignation to the
General Secretary through the President of the organisation, which they
represent.
Acting President
11. In case of President's post falling vacant at the Headquarter
of the Association, his duties will be carried out by the Senior Vice President
as Acting President, and he will exercise full powers of the President till
such time a new President is elected at the next AGM of the Association.
Disciplinary Action
12. (a) Disciplinary
action may be taken by the Association against any individual member, if he is
found guilty by two third of the members present in the meeting convened to
investigate into the allegations of having committed any one the following
delinquencies: -
(i)
Undesirable activities aimed at
disrupting the Organization.
(ii)
Indulgence in misrepresentation and distortion of the
facts, with the objects of
Injuring the
reputation and integrity of other co-members or Affiliated Organization.
(b) The disciplinary action may take any of
the following forms depending upon the decision of the President who will be
guided by the wisdom of the house.
(i) Forfeiture of the membership.
(ii)
Suspension from active participation for a certain
period.
(iii)
Administration of a strong warning.
13. Members, including the Office Bearers of the Association,
shall hold office for a period of 3 years except as provided for in clause 6
above. The period of Office Bearers shall commence from 1st December.
Members and Office Bearers shall continue in office after expiry of their terms
of office until their successors are elected without let or hindrance.
Management
14. The Association shall meet at least once a year or oftener, if
necessary, to conduct the affairs of the Association and at such meeting at
least one half of the total number of representatives of Affiliated Sister Organizations
of the Association shall form a quorum. All meetings shall be presided over by
the President. In his absence, Senior Vice President or in their absence, one
of the other members of the Association present so elected, shall preside.
Invariably a question raised, which has far reaching effect on the functioning of the Association, if
deleted, shall be decided by the majority of votes. Each member shall have one
vote. The Chairman shall have a casting vote in case of an equality of votes.
At least one month’s notice in writing of a meeting of the Association shall be
given to the m,embers but the period may be lessened in emergent cases.
15. In case of emergency, where there may not be sufficient time
to convene a meeting, the General Secretary may obtain the comments of members
of the Association by circulation of papers. Such decisions arrived at by
circulation shall be placed before the next General Body Meeting of the
Association for their confirmation. In the event of immediate decision being
necessary for the interest of the Association, the President, in consultation,
with the Senior Vice President will have the right to take decision, which may
later be confirmed by the other members at their next meeting.
16. The ultimate authority in all matters, including the Constitution
and the Administration of the Association shall vest in the members of the
Association, who shall meet at the Headquarters or any other place to be
decided upon by the President of the Association for the conduct of the
business.
17. It shall be competent to the Association to frame subsidiary by
laws for the conduct of the business of the Association consistent with the
Act, the Rules and these by laws. Such subsidiary by laws shall be entered in
the minutes of the Meeting of the Association and shall be effective only after
they are approved by minimum 2/3 members of the Association present at the Meeting.
18. The Association may compensate any member or Office Bearer or
such other persons, other than the paid staff of the Association as may render
service to the Association by way of an honorarium, sanctioned by a resolution
passed at the Meeting of the Association.
19. No amendment to the rule, by laws or the Enactment of a new by
law shall be made except by a majority of the two- third of the total number of
members of the Association present at the Meeting .
20. Subject to such resolution as the members of the Association
may from time to time pass the office bearers of the Association shall have the powers mentioned below: -
(a) President: - The
President shall exercise general control over all affairs of the
Association. He
shall have powers to appoint administrative staff/employee of the establishment
on the
recommendation of the General Secretary as well as fine, suspend or dismiss an
employee
of the
Association. In case of emergency the President may pass order on
administrative matters,
which shall be
placed before him by the General Secretary.
(b) Vice- President: - In the absence of the President, Senior Vice
President shall carry out
the duties of
the President.
(c) General Secretary: - The General Secretary shall be
responsible for the executive
Administration
of the Association subject to the control of the President and shall have
custody of
all papers,
documents and properties of the Association. Should the General Secretary
require
relief from
work, the President may grant such relief, making suitable arrangements for the
conduct of the
work. The powers and duties of the General Secretary shall be as follows: -
(i) To
take necessary action for the achievement of the objects of the Association.
(ii)
To enforce observance of the Rules and Bye- Laws of the
Association.
(iii)
To conduct all correspondences on behalf of the
Association.
(iv)
To be responsible for the safe custody of all papers,
files and other property of the
Association entrusted to him or received by
him in the ordinary course of business.
(v)
To summon meetings of the Association with the approval
of the President and
to circulate
notices, agenda thereof to the members.
(vi)
To record proceedings of the meetings of Association
and take necessary action
thereon.
(vii)
To examine accounts and to incur expenditure on petty
items without the prior
sanction of the
Association upto a sum not exceeding Rs.500/- at any time. A record of all
expenditure on this account will be maintained in the Imprest Account Book and
will be supported by receipt vouchers. Such records of expenditure should be
placed before the President for inspection and obtain countersignature at every
meeting of the Association.
(viii) To appoint, confirm, suspend or remove,
discontinue or dismiss any employee of the Association subject to the approval
of the President.
(ix) To be responsible for looking after the
general management of the Association and bring to the notice of the President
any matters of interest, grievances or complaint and to take his order thereon.
(c) Secretary: - He
will assist the General Secretary and in his absence hold
responsibility
as stated above.
(e)
Treasurer: -
(i) The Treasurer shall take charge of all
cash and funds of the Association and shall be responsible for it’s safe
custody and shall make disbursements only after obtaining
approval
of the President in accordance with the Rules and Bye Laws of the Association.
(ii)
He/She shall collect and receive cash on behalf of the
Association and issue receipt thereof.
(iii)
He/She shall deposit all cash in bank authorized by the
Association retaining on hand a cash balance not exceeding Rs.2000/- to meet
the current and emergent expenses.
(iv)
The/She shall keep a regular account of all cash
received and disbursements made and shall be responsible for the maintenance of
proper account books, vouchers etc. which should be submitted through the
General Secretary to the President for inspection and countersigned at the end
of every month.
(v)
He/She shall
prepare accounts and a balance sheet which after audit shall be considered at
the Annual General Meeting of the Association.
(vi)
All payment shall be supported by receipt and vouchers
duly passed by the
General Secretary
Procedure for Meeting
21. The General Secretary of the Association shall convene all
meeting of the Association as and when
necessary in consultation with the President or in his absence the Senior Vice
President. A meeting can also be convened by a written requisition duly signed
by members representing not less than two-third of the existing members of the
Association and for such a meeting not less than 3 weeks notice has to be
served. At least one month’s notice shall ordinarily be given of a meeting to members of the Association and the notice
and agenda shall be sent by post UPC or delivered personally. Non-receipt of
notice by a member shall not invalidate the proceeding of the Meeting. A member
desiring to propose a resolution at a Meeting or to discuss a subject falling
within the preview of the objects of the Association shall give notice in
writing and send notes on the subjects at least 3 weeks prior to the Meeting
and he shall at the same time circulate copies of such resolutions or notes on
the subject to other members also.
Travelling Allowance including Daily
Allowance to Members
22. The members of the Association shall be
eligible for the following travelling and daily allowances:-
(a) Railway Fare:- Actual
Second Class railway fare from place of departure to the place of
the Meeting and back by the shortest route. First
Class /AC/II Tier fare will be admissible to only those Members who are t the
time of their retirement from service or in view of their professional status
are/were entitled to travel First Class/AC II Tier. Others will travel by
second class as stated above.
Note:-
(i) The
shortest route shall be that by which
the traveler can most speedily reach his destination by the ordinary modes of
travelling.
(ii) The
point in any station at which journey is held to commence or end is the railway
station in the case of train journey.
(b) Road Mileage:- As authorised by the Government
of India to its employees grade wise.
(c) Daily Allowance:- Daily Allowance @ Rs. 250/- per day
for the journeys and halts, provided the absence from the respective
Headquarters exceeds 8 consecutive hours. In the case of President of the
Association , he will be entitled to Rs.
/- per day. Daily Allowance may not be drawn for a continuous halt of
more than 10 days at any once place, provided the President may grant general
or individual exemptions from the operation of this rule on such conditions as
the said authority thinks fit and is satisfied:-
(i) That
the prolonged halts are necessary in the interest of the association.
(ii) That
such halts continue after the first 10 days to entail extra expenditure upon
the member concerned.
(d) Conveyance Charges at Out-
Stations:- Members may be granted in addition to any other
travelling allowance that may be admissible reimbursement of bonafide charges
on account of conveyance hire incurred by them in the discharge of their duties
subject to the following conditions:-
(i) That
the concession is limited to journeys performed to and form a meeting place if
the distance covered is more than one mile from the place of his residence at
out-station to the place of meeting or vice-versa.
(ii) That
amount does not exceed the charges which would be payable for the ordinary
means of conveyance available in that locality.
(iii) That
the conveyance charged do not exceed the monetary limit of Rs. 50/- per diem.
(iv) That
the claim for such charges are preferred in the T.A. claim bill at Appendix A
of the Bye Laws of the Association showing full particulars of the journeys
thus performed.
23. The
travelling allowance should be claimed by the members concerned in the Bill at
Appendix A. the General Secretary will scruitinise the T.A. Bills and pass the
claims for the payment by the treasurer.
24. For the
purpose of scrutiny, a period of absence from Headquarters begins when a member
actually leaves his Headquarters and ends when he actually returns to the place
in which his Headquarters is located. In case of members representing
affiliated organisation the town where the registered office of the
organisation is located will be considered the Headquarters of the respective
reprentative. The time recorded in the Railway Time shall ordinarily be taken
as the time of departure and arrival of the train for the purpose of scrutiny
in the Travelling Allowance Bill.
25. Office
Contingency:- Sister
Organisations shall be paid office contingency @ Rs.1000 /- to be paid annually. Payment may be made during AGM.
